INTRODUCTION
Clinic Ego provides health tourism services and acts as an intermediary to ensure individuals seeking healthcare can access services under the best conditions. This agreement governs the terms of the relationship between individuals receiving healthcare services through Clinic Ego and the clinic, outlining the responsibilities of both parties. Any individual wishing to receive services via Clinic Ego must accept the terms stated in this agreement. By agreeing to this contract, patients legally accept its conditions at all stages of the services provided by Clinic Ego. Those who do not accept these terms will not be eligible to receive services. The terms and conditions are as follows:
DEFINITIONS
Contract: This agreement.
Clinic Ego: Clinic Ego Health Tourism JSC, located at Şişli, Istanbul, Türkiye.
Patient: Any individual receiving healthcare services through Clinic Ego.
Physician: The healthcare professional providing the medical service.
Service Provider: The organization or facility delivering healthcare services.
SCOPE OF SERVICES AND RESPONSIBILITIES OF CLINIC EGO
- Clinic Ego facilitates consultation and dialogue between the Patient and the Physician. It provides preliminary information about requested procedures and offers support for transportation and accommodation if the procedure is approved.
- Under this contract, Clinic Ego will provide support in:
a) Detailed information about the Patient’s healthcare package.
b) Cost details for the package.
c) Information regarding visa and passport requirements (also available at https://www.evisa.gov.tr/en/).
d) Health-related travel and accommodation formalities.
e) Travel schedules, including intermediate stops and transportation links.
f) Contact information for the Physician, Service Provider, or a local agent for assistance. - Clinic Ego acts solely as an intermediary in health tourism, not as a healthcare provider. It does not provide medical advice or control the facilities or services of Service Providers. Treatments are conducted under a direct agreement between the Patient and the Service Provider. The Patient acknowledges that Clinic Ego is not medically qualified and assumes no liability for medical procedures, outcomes, or any claims related to treatment, negligence, or dissatisfaction arising from the Service Provider.
- Clinic Ego provides treatment plans based on information (e.g., photos, test results, prescriptions) provided by the Patient, which is reviewed by the Service Provider. The Service Provider may alter or refuse the treatment plan after an in-person evaluation. If changes occur, the Patient may opt to discontinue treatment, with reimbursement after deductions for prior expenses. Clinic Ego does not cover travel, accommodation, or transfer costs in such cases.
- If the Patient chooses to proceed with a revised treatment plan, Clinic Ego provides an updated cost breakdown, including any additional expenses. Clinic Ego is not responsible for irregularities or extra costs arising from treatment plan changes.
- Non-Disparagement: The Patient agrees not to publicly criticize or harm the reputation of Clinic Ego or its staff (e.g., on social media). Clinic Ego cannot be held responsible for the Service Provider’s actions. Violations of this clause will require the Patient to remove disparaging content and compensate Clinic Ego for damages.
- Clinic Ego does not guarantee or control services provided by third parties (e.g., travel companies, hotels). The Patient acknowledges that third-party terms apply, and Clinic Ego is not liable for any damages resulting from their services.
- If Clinic Ego cancels or modifies a reservation, it will notify the Patient promptly. The Patient can reschedule or cancel the booking for a refund after deductions. Clinic Ego is not liable for indirect costs or damages arising from cancellations or changes caused by force majeure (e.g., natural disasters, flight delays, strikes, epidemics).
PATIENT RESPONSIBILITIES
- The Patient must review all materials provided by Clinic Ego and resolve any uncertainties before accepting the contract.
- The Patient is responsible for:
a) Ensuring valid passports, visas, and other travel documents.
b) Providing required information to Clinic Ego, Service Providers, or airlines.
c) Researching travel health requirements and vaccinations. - Failure to fulfill these responsibilities or providing incorrect information may result in service disruptions or denial of entry to the destination country. Clinic Ego is not liable for such consequences.
- Clinic Ego advises the Patient to secure comprehensive travel insurance to cover potential liabilities, including medical issues or trip interruptions.
MEDICAL HISTORY AND RECORDS
- The Patient agrees to share medical history and records (e.g., test results, x-rays) with Clinic Ego, which forwards them to the Service Provider. Incomplete or inaccurate records absolve Clinic Ego of liability for negative outcomes.
- Clinic Ego may maintain the Patient’s records, including treatment plans and before-and-after photos, for service provision purposes. This data will not be shared or sold without the Patient’s consent.
PAYMENT
- Payment terms, costs, and services included in the package will be provided to the Patient in a separate form.
- Additional costs for unforeseen procedures, extended hospital stays, or specific medical needs are the Patient’s responsibility.
- A deposit is required to secure a reservation, with the remaining balance due before departure. Failure to fulfill payment obligations constitutes a breach of contract.
CANCELLATIONS
- The Patient may cancel a reservation by providing written notice. Fees and deductions will depend on the cancellation timeline. The deposit will remain with Clinic Ego as a reservation fee.
DATA PROTECTION AND PRIVACY
- Clinic Ego stores Patient data securely and does not use it for unauthorized purposes. The Patient accepts the terms outlined in Clinic Ego’s Privacy Policy.
- Clinic Ego complies with Turkish and international data protection laws, using Patient information only for service provision and research purposes.
APPLICABLE LAW AND JURISDICTION
This contract is governed by Turkish law and subject to the exclusive jurisdiction of Turkish courts.
ENFORCEMENT
By engaging with Clinic Ego, the Patient acknowledges that they have read, understood, and accepted this contract.
